What is medical malpractice?

What is medical malpractice? Medical malpractice is when a physician or a medical provider that has a patient relationship with an individual and fails in some way. For example, they could either fail to do something that they should have done or they actually do something that should never happen and never occur in the course of their medical practice. For instance, it could be a surgeon that accidentally cuts an artery or a nerve during a surgery and causes permanent damage to a patient.

Often, people come and they ask us whether they have a case for medical malpractice. When we’re asked this, we’re really looking for one thing. This is what the doctor should have done. Or, what they did do that was incorrect. And this is based on medical standards in the field. It’s important to note that the subject is very difficult. As a result, it takes an attorney with experience in medical malpractice to know whether you have a case or not.
