What Is Zofran? What Are the Issues?

Zofran, or ondansetron, is a prescription medication designed to prevent nausea and vomiting, particularly in cancer patients undergoing treatment. Cancer treatments such as chemotherapy can cause nausea and loss of appetite. The purpose of Zofran is to subdue nausea in cancer patients and people who experience nausea after surgery. Zofran inhibits serotonin, which transmits the signals that cause vomiting. Despite the drug’s effectiveness at preventing nausea, the FDA never approved it for use by pregnant women.

In the 1990s, Zofran became the most popular drug to combat morning sickness during pregnancy. In March 1999, the FDA issued a warning against GlaxoSmithKline, ordering the company to halt the distribution of its marketing materials, since the materials failed to address the potential risks of pregnant women taking the drug. Four years later, GlaxoSmithKline employees came forward with claims that the drug maker promoted Zofran for morning sickness despite knowing the potential dangers. In 2011, the U.S. Justice Department filed a lawsuit against the manufacturer for health care fraud and settled for $3 billion.

Zofran Injuries and Side Effects

The children of pregnant women who took Zofran may suffer birth defects because of chemicals in the drug. Birth defects related to Zofran include congenital heart defects, abnormal heart rhythm, kidney defects, cleft palates and lips, clubfoot, skull deformities, permanent disabilities, and wrongful death. Mothers who took Zofran during their pregnancies may have grounds for lawsuits against GlaxoSmithKline for negligently failing to disclose the risks of birth defects to consumers.

Potential Compensation Options

Today, hundreds of individuals have filed lawsuits against GlaxoSmithKline for Zofran-related birth defects and health complications. Almost 500 Zofran lawsuits are in federal courts, as well as multidistrict litigations and class actions. Ongoing lawsuits allege that the manufacturing company knew or should have known of the potential prenatal dangers of exposure to Zofran yet failed to warn patients. They also allege that the company violated federal laws in marketing the drug to pregnant women without FDA approval. If Zofran negatively impacted your child, you could be eligible for compensation.
